Release and Waiver of Liability, Assumption of Risk, Indemnity Agreement, and Consent

(Read Carefully Before Signing)

In consideration of being permitted to participate in any way in the programs, classes, or activities at Impact Martial Arts, and/or being permitted to enter any restricted area, I (and/or the parent/legal guardian of a minor participant) agree as follows:

1. Inspection of Facilities and Equipment

I understand it is my responsibility to inspect the facilities and equipment prior to participation. If I believe anything is unsafe, I will immediately notify staff and refuse to participate until the condition is corrected. I will not continue participation in any unsafe activity.

2. Acknowledgment of Risks

I fully understand and acknowledge that:

• Participation in martial arts involves risks of serious injury, including permanent disability, paralysis, or death.
• These risks may result from my own actions, the actions or negligence of others, or the condition of the facilities, equipment, or premises.
• There may be risks that are not known or are not reasonably foreseeable at this time.
• Potential losses from these risks can be severe, including social and economic damages.

3. Assumption of Risks

I knowingly and freely accept all such risks, both known and unknown, and assume full responsibility for my participation.

4. Release and Waiver of Liability

I hereby release, discharge, and covenant not to sue Impact Martial Arts, its owners, instructors, employees, agents, landlords, insurers, and affiliates (collectively, the “Releasees”) from any and all liability, claims, demands, or causes of action for injury, disability, death, or property damage, even if caused in whole or in part by the negligence of the Releasees.

5. Indemnification

If I (or anyone on my behalf, including my minor child) bring a claim against the Releasees, I agree to indemnify, defend, and hold harmless the Releasees from any litigation expenses, attorney fees, or damages incurred as a result.

6. Emergency Medical Consent

In the event of an accident, illness, or injury during participation, I authorize Impact Martial Arts staff, representatives, or emergency personnel to secure necessary medical treatment for myself (or my child). I understand that I am financially responsible for any medical expenses incurred as a result.

7. Photo/Video Release

I grant Impact Martial Arts permission to take and use photographs or video recordings of myself (or my child) for promotional or educational purposes, including but not limited to social media, websites, flyers, and other marketing materials. I waive any right to compensation or ownership of such media. (If you do not consent, please cross out this section before signing.)

8. Severability and Governing Law

This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Illinois. If any portion is held invalid, the remainder shall continue in full force and effect.

9. Acknowledgment of Understanding

I have read this Release and Waiver of Liability, fully understand its terms, and understand that I am giving up substantial rights, including the right to sue. I sign it freely and voluntarily, without inducement, assurance, or guarantee.

10. Communicable Diseases and Health Acknowledgment

I acknowledge that martial arts training involves close physical contact with others and the use of shared facilities and equipment, which may increase the risk of exposure to communicable diseases (including but not limited to colds, flu, COVID-19, staph infections, ringworm, athlete’s foot, and lice). I voluntarily assume all risks related to exposure to communicable diseases that may occur during participation.
